A will specifies who gets what (more on that below), but those aren’t the only decisions you’ll be making. You’ll also name someone as an Executor who ensures that your wishes are carried out. If you have minor children, you may also set up a Guardianship and a Conservatorship, to address their future care and financial security. In some cases, your attorney for estate planning will recommend setting up a trust, which can help some of your assets avoid the probate process entirely. A trust can also shield your holdings from estate taxes and other claims, as well as provide for children with special needs.

An Estate Planning package also typically includes a Living Will and Healthcare Power of Attorney. Here, you’ll have options regarding your care during the end stages of life. There should be complete clarity about the distribution of your financial and other assets after you’re gone, to help avoid uncertainty or potential conflict among those left behind. We’ll set things up to help probate go smoothly, and in fact try to avoid probate as much as possible. The estate planning attorneys here will begin by helping you list all your assets, both financial and property. Then you’ll specify how those assets should be awarded or split. Liabilities such as mortgages and liens will also be accounted for.

We can help with that as well. To avoid problems later, a will needs to be kept current, reflecting life’s changes over the years. For example, if a person gets divorced or remarried, or if one of their beneficiaries passes away, their will should be revised to accommodate their current wishes. If the changes are minor, and the will isn’t too old, it may be able to be updated. Otherwise, drafting a new will – and other estate planning documents – may be the best move, especially since the relevant laws do change over time.

By law, a local Probate Court conducts the legal procedure that makes sure that the person’s assets are distributed according to their wishes, creditors are paid, and nothing is amiss. If there’s a clear and current will, the process tends to go smoothly. If not, the Probate Court has a standard formula for distributing assets, but the Probate Judge has some say. If there’s a dispute, the process becomes more complex.
